notify the us it will take us gay marriage cases including california's ban on same-sex marriage unions. we got the word and our correspondent is with us on the phone now. shannon, what is the story? >>shannon: they decided to take up to different gay marriage cases. you mention the one from california, you may remember proposition eight. the voters passed a measure that allows only the recognition of one man, one woman as a "marriage." a federal court overturned that. that want on appeal to the supreme court and they decided they will weigh in on that fight. in addition there were eight cases on the diagnosis -- the docket on the defense of marriage act and a portion only recognizes marriage as between a man and a woman and has been challenged dozens of times. they agreed to take up a case dealing with defense of marriage act. two different cases but both going to the same issues. they are different on technical and legal points but the bottom line is the same and the court has told us it will hear two gay marriage cases and we expect the earliest to get on the calendar is march of 201

-- especially in northern california. that is really where the bullseye of the rain has been. all kind of flooding concerns, flood watches and warning in effect from san louis obipspo to oregon. we are seeing the precipitation in oregon and washington as well, but the bullseye really has been across northern california. this is the future radar. we see the rain, it dies down toward the south, maybe rain in los angeles then a break for the day tomorrow. then the next storm moves in on tuesday. all of the pacific northwest to northern california again. after that, we start to see things calm down. we have to get through the next couple of days with heavy rain. the heaviest in san francisco, up around sacramento. a lot of the rivers here are well past flood stage. a couple of them likely even getting toward the all-time records. one other thing, a little rain moving to the northeast today. not any huge problems. i have a long with it, very warm conditions. we are going to see all kind of record high temperatures broken. in the 60s across the northern plains in early december. that is

gay marriage cases prop 8 out of california and the defense of marriage act case out of new york. the court could hear the cases as early as march. okay. two big issues here. let's start first with -- i think we will start with the gay marriage issue first and then we will go to the pot question. steve, how do you think it's going to play out the doma case prop 8 case how two different cases how do you think doma case. >> doma case involves whether someone who had lived with domestic partner for 45 years should have to pay estate taxes where if they lived as husband and wife she would not have to pay estate taxes and prop 8 involves whether or not gay marriage is simply legal. i think what we are seeing here they only need four justices to decide whether to take the issue. i think there is a little bit of politics there because if obama appoints more justices, they are not going to have to get the issue before the court. i think expect that the court going to say that gay marriage is legal just as they said you couldn't ban racially mixed racial marriages and things of that sort. you
